• The contract was signed on the 20 February 2008 at the Builder and Estate Agents office in Factoria in the presence of the named Estate Agent, Building Contractor and the Buyers.
• On 22 February 2008 the Buyers paid in to Mr. Abraham M van der Walt personal bank account at Standard Bank
• (Money Market Account No. 256955 62194343005 Key West Branch)
• The amount of R 500 000.00 as a deposit on the property.
• In March 2008 the bath room equipment purchased according to the contract in the amount of (R 140 000.00) and a payment was also made for a wooden deck in the amount of (R50 000.00)
• The loan agreement was approved with Nedbank Limited on 20th March 2008 Account number 8157460953101 for the amount of R 1 900 000.00.
• The payments to the contractor will at that stage be paid as the building progressed.

The Bank reassessed the already approved bond in June 2009 and demanded new Business balance sheets from the Buyers Accountants.

The approval of the bond had already been granted a year before and no drawings for the building in progress was made.

After numerous negotiations between the Attorneys, there appeared to be a problem with the dividing of the property.
At that stage there was no portions nominated and according to the bank, all belongs to the Buyers.
A correction had to be made at Bank level and for any inquiries the Attorneys that are working on the account can be contact.

In April 2009 the Buyers Business (Power back up solutions cc) was in the process to be liquidated.

1. We have contacted the City Planning department at Mogale City with the suspicion that there where no Water, Power or Electrical connections on the Property.
2. (We where asked to file a complaint with the Counsel for an investigation.)
3. Knowing that no Building inspector had approved the foundations or the concrete slab, no building plans were handed in
4. And due to that no planning could be made for the infrastructure on the property.
5. (Cost to the Contractor +_ R 1 200 000.00 for the complex.) Taking this action will complicate the situation.
6. Mrs. Geldenhuys fell sick in July 2008 (3x Strokes) and is paralysed on the left side of her body.
7. We still managed to get past that by installing a lift on the staircase. This would have given her access to the living area on the lower level of the house.
8. Unfortunately Mr Geldenhuys, also because of a neck operation became disabled in March 2009 and the dream house became a nightmare.
9. The Bank, due to the present economy did a reassessment on our lone application and as Mrs. Geldenhuys was the owner of a private business asked for new bank statements and balance sheets for 2008, 2009 on the business.
10. We were and are still not able to provide that as the business is in the process of liquidation.

We have signed an agreement with STIRE PROPERTIES on the 20 February 2008,
The Bond on the property was approved in March 2008 and to this date the house is still not near completion. (01 December 2009)

We rented a house in Rant en dal 18 Duiker Street and gave notice to the owner, with the understanding that our new house will be ready three times in this period.

We were given notice by the owner to be out of the house by the end of October 2009
. (No income at all) totally unemployed not able to work.
We had a meeting with Mr Abraham M van der Walt in August 2009 at the Rant en dal address Explaining our present situation.
Mr. Abraham M van der Walt wanted some time to consult with your Attorneys (Blackie Swart & Associates Incorporated) Tel. number 011 953 6867) and will arrange a follow-up meeting

We had a meeting with Mr. and Mrs. Van der Walt at the end of November 2009 trying to explain the situation that we are at the moment and to find a solution that will soot us bought.
