Subject: Car high purchase (jeep cherokee) from Brighton Jeep

To whom it may concern,

Few months ago late in may 2008 i was interested to buy a new/second hand car to my wife as a birthday present, we both went to Brighton Jeep dealer in brighton to look at few cars and get a better idea about prices. there we met Chris Malseed that was very helpfull and showed us few cars that they keep in the yard.

we took one of the cars for a short drive and my wife liked it a lot, i explained to chris that this is a bithday present but i still need to think about it, chris told us that this is very unique jeep and wont stay in the yard for long, therefore storngly suggested we should realy put a deposit so they can keep it for us. My wife really wanted the car so i agreed to pay deposit and confirmed few times with chris that the purchase is SUBJECT TO FINANCE APPROVAL therefore if my finance application declines i receive my deposit back. as it was late in the day chris suggested we do the finnance on monday, meantime i filled in the forms and signed the agreement form - i also added in my own hand writing that this purchase is subject to finance approval.

I was in touch with chirs on weekly basis (i have copies of all our email conversations) as i was trying to get finance approval for the car, a month later (end of july 2008 - 4 weeks after) i contacted chris and told him that i could not get the finance for the car and to please refund my card with the $1000 i paid, i did not receive a reply back from chirs.

last month my wife and i got back from overseas after getting married and spending 2 months away, when we got back we looked through our bank statements and could not see the $1,000 refund from brighton jeep then we tried contacting chirs malseed and decided to send few emails to him and to Karen the lady who processed the deposit, eventually few weekd ago after several attepmts to contact anyone at brighton jeep we finally got an email reply (they did not even have the courtesy to phone me back after i left them so many messages) from them saying that they are not going to refund me the $1000 deposit i paid.

I was shocked as Chris was the one who pushed us towards paying the deposit and promised us that we will get our money back if the finance is not approved, i only paid theh deposit to brighton jeep so they keep the car for me as chris suggested, however now he is saying that he never said that and the deposit wont be refunded as they have been waiting for my finance to be approved for too long.

I do not have any documents from the dealer as i dont think they gave me anytihng, they kept all copies there from some reason, however i do have all copies of emails that i was communicating with the dealer in regards to the loan approval.

I kept calling brighton jeep trying to get through to chris malseed but he is always unavailable i asked to speak with anyone else there and they kept asking for my number and promised me that someone will call me back but i was not surprised to see that NO ONE called me back ever. i left so many messages but nothing i never received such a shocking service as i received in the past few months from brighton jeep.

Last week (11 Dec 08) i finally got through to chris malseed and again i mentioned to him that i wrote in big bold letters on the agreement form that the purchase is subject to finance approval and if our finance application is not approved i can not buy the car and the deal is cancelled - i told him again that we BOTH agreed to it and that was the reason for my down payment and suggested that they will refund my card with the 1000$ deposit i paid! chris reply was "sorry we are not going to refund you the $1000 you paid we are keeping the money".

The last thing i could do was to ask chris for a copy of my agreement as they never gave me one, i know i am entitled to receive a copy by law, i would like to see the agreement form i signed, brighton jeep policy i guess is a bit different, they are not giving their clients copy of agreements signed, i also mentioned that i want something as a receipt of my $1,000 payment as i really have nothing - i dont even have the receipt of payment as they processed the $1,000 on my credit card on monday without my signature!!! so i phoned again and demanded to see a copy of my agreement form i would like to have a copy of my $1,000 payment to Brighton jeep! i think it is fair at least be a bit professional and show me the agreement i signed - brighton jeep kept puching me back and refused to show or send me anytihng, i know and perfectly rememeber that i wrote in big letters on the agreement form that the purchase is subject to finance therefore i am right and entitled to get my money back.

17 Dec 08 - again i kept calling brighton jeep asking for a copy of my agreement eventually after knocking me back few times i got to speak with Damian, he perfectly explained to me that brighton jeep are not going to do any of the below:

A) Refund my money
B) Show or send me a copy of my agreement form
C) send me a receipt for my payment

The buttom line is that i have nothing, no agreement no receipt of payment no car and 100% NO SERVICE - i didn not expect such a BAD service from brighton jeep - unreal!!!

18 Dec 2008 - i now pointed to VCAT to issue a court demand for brighton jeep to issue me a copy of agreement signed and print receipt of my payment.
