Eureka st Furniture (sunshine coast) ( Queensland, Australia)

2008-12-20

We were looking for a new bed and found a nice leather bed in the Kawana Eureka furniture store Sunshine Coast. Knowing what we know now we would not have even bothered. Everything seemed fine at first, we chose the bed and paid $99 deposit and was told that it would arrive from Brisbane the following Thursday. When we signed the invoice and paid the deposit we were not told that it was or could be damaged stock, however the sales person did write discontinued stock line and sold as is but we were made believe it was new and it did come out of a new box. By the way this item was advertised in the sunshine coast daily as a sale item…. Reduced from $1599 to $600. I know it wouldn’t sell at the dearer price however $600 was reasonable (I thought). Anyway I picked it up on the Thursday paid the $500 balance and took it home fully boxed and no damage was visible on any cartons, but upon opening there were scratches in the leather, a staple sticking out of the bed head and some stitching coming undone. I rang and told them and they said they would replace it in a week. Not a problem just a little inconvenient. (Another week sleeping on the floor). The bed was one day late and once again, not a problem. This time they opened the cartons for me at the shop and believe it or not, it was scratched again. I wasn’t really happy about having paid for a new bed to have to compromise and except it, the sales women said the mattress would cover the damage and that we signed to buy as is. We asked for a refund based on already being inconvenienced twice and then being told that we should accept it. Surprisingly enough they have a company solicitor ….. how convenient! He rang us and was quiet rude to my wife and said he suggests we call Office of Fair Trade as he wasn’t giving us anything but the bed we rejected. We were shocked and very disgusted that they could treat us like that and we spent a week or two liaising with OFT, but their solicitor had an answer for everything and told them we signed for the bed as is and then used bullying tactics on us by saying to OFT that if we don’t remove the bed from the shop he was charging us $10 a day for storage and if it stayed there to long he would throw it out and charge us a disposal fee on top. At this stage we felt the OFT just threw up their hands and said that we were in the wrong …. The OFT wasn’t getting answers or proof about questions we were asking them ie … where is the proof that we signed for the bed …in fact we were forced to collect the bed and still to date I have never signed for the bed. I am unsure what powers if any this organisation (OFT) really has but that's another story. We have been bullied, intimidated, and during the 6 weeks we slept on the floor we were treated like scum by staff and management at Eureka furniture just because we bought a bed and wasn’t happy walking out the door with it damaged in the first place ….. I am so angry with their disgusting service and lack of customer service… but what can I do, to obtain legal services and fight these morons would not be worth it and they know it, that’s why they do what they do …. I would rather throw it to the tip. Enough of my problems …. Just be aware
